2.2 Responsibility

You are solely responsible for ensuring that:

  • You own or have rights to all content you upload
  • Your content does not infringe on the intellectual property rights of others
  • You have obtained all necessary permissions and licenses

3. Reporting Copyright Infringement

If you believe that content on ÄRI infringes your copyright, you may submit a copyright infringement notice to our designated agent.

3.1 Required Information

Your copyright infringement notice must include:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed
  2. Identification of the infringing material: The specific URL(s) or description of where the allegedly infringing material is located on ÄRI
  3. Your contact information: Your name, address, telephone number, and email address
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
  6. Signature: Your physical or electronic signature

4. Our Response to Infringement Claims

Upon receiving a valid copyright infringement notice, we will:

  1. Review the notice: We will review the notice to ensure it contains all required information
  2. Remove or disable access: If the notice is valid, we will promptly remove or disable access to the allegedly infringing material
  3. Notify the user: We will notify the user who posted the content about the removal and provide them with a copy of the notice
  4. Document the action: We will keep records of the notice and our response

5. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notification.

5.1 Counter-Notification Requirements

Your counter-notification must include:

  1. Identification of removed material: Identification of the material that was removed and its location before removal
  2. Good faith statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the courts in Estonia or your local jurisdiction
  4. Your contact information: Your name, address, telephone number, and email address
  5. Signature: Your physical or electronic signature

5.2 Counter-Notification Process

Upon receiving a valid counter-notification:

  1. We will forward the counter-notification to the original complainant
  2. If the complainant does not file a court action within 10-14 business days, we may restore the removed content
  3. If a court action is filed, the content will remain removed pending resolution

6. Repeat Infringers

ÄRI has a policy of terminating accounts of users who are repeat infringers of intellectual property rights. We may terminate your account if:

  • You receive multiple valid copyright infringement notices
  • You repeatedly upload infringing content
  • You submit fraudulent or abusive counter-notifications

We maintain discretion in determining what constitutes a "repeat infringer" and may consider the context and circumstances of each case.

7. Misrepresentation Warning

Warning

Under various copyright laws, including the DMCA, anyone who knowingly misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.

Please ensure that you have a good faith belief that the material infringes your copyright before submitting a notice. Similarly, ensure you have a good faith basis before submitting a counter-notification.

8. Trademark Claims

If you believe that content on ÄRI infringes your trademark rights, please contact us at contact@ari.com.ee with:

  • A description of your trademark and its registration details
  • The specific content that you believe infringes your trademark
  • An explanation of how the content infringes your rights
  • Your contact information

We will review trademark claims and take appropriate action.

9. ÄRI's Intellectual Property

The ÄRI name, logo, website design, and platform features are the intellectual property of Äri Operasys OÜ. You may not use our trademarks, logos, or other proprietary information without our prior written consent.

10. Service Provider Protection

ÄRI operates as a platform that hosts user-generated content. We do not monitor all content uploaded by users before it is posted. We take appropriate steps to address infringing content when notified through proper channels.

11. Changes to This Policy

We may update this Copyright Policy from time to time. Changes will be posted on this page with an updated effective date.
